These Terms of Use (“Terms”) govern your access to, and use of, the websites (each, a “Site” or “Website”), mobile applications, the mobile text program, third party messaging platforms, and online services or programs (collectively, the “Services”) operated by or on behalf of the Fritanga Monimbo restaurant group of companies (“Fritanga”) and on which these Terms appear. These Terms are a legal and binding agreement between you and Fritanga. Your use of the Services indicates your acceptance of these Terms. Do not use the Services if you do not agree to be bound by these Terms.

Fritanga operates multiple restaurant locations, each with its own phone number, under one unified website and brand.

Fritanga strives to ensure that the information contained on the Services is accurate and reliable. However, Fritanga and the Services are not infallible and errors may sometimes occur. Therefore, to the fullest extent permissible pursuant to applicable law, Fritanga makes no representations about the reliability of the features of the Services, the Fritanga Content (defined below), Submitted Content (defined below), or any other Service feature. You acknowledge that any reliance on such material and/or systems will be at your own risk.

The Services are provided on an “as is, as available” basis without any representation or warranty, express or implied, of any kind. To the fullest extent permitted by law, Fritanga hereby disclaims all warranties of any kind or nature, including, but not limited to, the implied warranties of merchantability, accuracy, non-infringement, and fitness for any particular purpose.

TEXT MESSAGING NOTICE (A2P 10DLC COMPLIANT)

By opting into any Fritanga mobile text program, whether through online forms, in‑store sign‑ups, keyword opt‑ins, or other written consent methods, you expressly consent to receive recurring automated marketing and informational text messages from or on behalf of Fritanga at the mobile number provided.

Consent to receive text messages is not a condition of any purchase.

Message and data rates may apply. All charges are billed by and payable to your mobile service provider.

Opt‑Out Instructions

To opt out of the Fritanga mobile text program, text STOP to 888222 (U.S.) or 888333 (Canada). You will receive one final confirmation message confirming your opt‑out. After that, you will no longer receive messages from the program.

STOP is the exclusive method to unsubscribe.

Carrier Disclaimer

Fritanga and mobile carriers (including but not limited to T‑Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages.

Data Collection & A2P Compliance

Data collected in connection with the SMS program may include your mobile phone number, carrier information, message content, timestamps, and opt‑in records.

No mobile information, including SMS opt‑in data and consent, will be sold or shared with third parties or affiliates for marketing or promotional purposes. Information may be shared only with authorized service providers, aggregators, and messaging platform vendors solely for the purpose of delivering text message services and supporting compliance obligations.

Fritanga complies with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles & Best Practices, and applicable A2P 10DLC registration and carrier requirements.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Fritanga, its affiliates, its providers, and its officers, directors, employees, attorneys, and agents from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), and expenses that arise directly or indirectly out of or from: (1) your breach of these Terms; and/or (2) your activities in connection with the Services.

USER‑SUBMITTED CONTENT

Certain areas of the Services enable you to submit remarks, ideas, images, photos, suggestions, graphics, and/or other materials (“Submitted Content”). By submitting such content, you acknowledge that you are responsible for the material and that Fritanga may use the Submitted Content for commercial or other purposes without compensation.

ONLINE PURCHASES

To purchase food products, merchandise, or other items through the Services, you must provide valid payment and billing information. By completing a purchase, you agree to pay the stated price, applicable taxes, and fees displayed at checkout.

WEBSITE ACCESS

Fritanga grants you a limited, non‑exclusive, non‑transferable license to access and use the Services for personal, noncommercial use, provided you comply with these Terms.

You may not copy, distribute, modify, reverse engineer, scrape, or otherwise misuse the Services.

HYPERLINKS

The Services may contain links to third‑party websites. Fritanga is not responsible for the content or practices of external websites.

VIOLATION OF TERMS

Fritanga may suspend or terminate your access to the Services if you violate these Terms. Fritanga reserves all legal and equitable remedies.

GOVERNING LAW

These Terms are governed by United States law and the laws of the State of Florida, without regard to conflict of law principles.

DISPUTE RESOLUTION & ARBITRATION

All disputes arising from these Terms shall be resolved through binding arbitration as previously outlined in these Terms. Class action claims are waived to the fullest extent permitted by law.

MISCELLANEOUS

These Terms constitute the entire agreement between you and Fritanga regarding use of the Services and supersede prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect.

BINDING AGREEMENT

By using the Services, you acknowledge that you are capable of entering into a binding agreement and agree to be bound by these Terms.
